NEXXTUP Privacy Policy (2026)

This Privacy Policy (“Policy”) describes how NEXXTUP, Inc. (“NEXXTUP,” “we,” “us,” or “our”) collects, uses, shares, and otherwise processes personal information, and how you may exercise your privacy rights and choices.

SCOPE

This Policy applies to the NEXXTUP platform, including related mobile applications, products, websites, technology, software, and services (collectively, the “Services”). Please also review our Terms of Service, which govern your use of
the Services.


Under this Policy, NEXXTUP acts as a data controller (or “business,” where applicable under U.S. law) with respect to the personal information we process. This means we determine the purposes and means of processing personal information.

INFORMATION WE COLLECT

Information You Provide

Account Information.

We collect information you provide when creating or managing your account, such as your name, email address, phone number, date of birth, username, password, and similar identifiers.


Profile Information.

We collect information you choose to provide about yourself, such as profile photos, gender (if provided), preferred sport(s), skill level, competitive tier, team affiliations, biography information, and other profile content.
Competitive and Participation Information.
We collect information you submit relating to matches, tournaments, events, teams, results, standings, rankings, ratings, and other competitive activity.


Contacts’ Information.

You may choose to provide contact information from your device or social accounts to help connect with other users. If you do so, we may access and store that information to facilitate connections.

Support Information.

We collect information you provide when contacting customer support, submitting feedback, or reporting concerns.

Information From Your Use of the Services

Content You Share.

We collect content you post, upload, transmit, or otherwise make available, including text, images, videos, comments, direct messages, match results, player ratings, tournament brackets, and other user-generated content.
Activity and Participation Data.


We collect data relating to your athletic activities, participation in games, match outcomes, team assignments, standings, performance metrics, and other competitive information you record or upload.

Location Information.

We collect or infer location information when you use location-enabled features. If you enable precise GPS tracking for certain features, we collect precise location data through your device permissions. You may disable precise location through your device settings.

Usage Information.

We collect information about how you interact with the Services, including login times, feature usage, tournament participation, messaging activity, clicks, navigation patterns, and interactions with other users.

Performance and Ranking Metrics.

We generate performance insights, ratings, rankings, and comparative metrics based on your participation data and system logic.

Device Information.

We collect technical information about devices used to access the Services, including device identifiers, IP address, browser type, operating system, network information, and diagnostic logs.

Cookies and Similar Technologies.

We collect information through cookies, SDKs, pixels, analytics tools, and similar technologies. See “Cookies and Similar Tracking Technologies” below.

Payment Information.

If you purchase subscriptions or other paid features, we collect transaction details such as purchase history and partial payment information. Full payment card data is processed by PCI-compliant third-party processors and is not stored by NEXXTUP.

Information From Other Sources

Connected Devices and Apps.

If you connect third-party devices or applications, we may receive information from those integrations consistent with your authorization.

Third-Party Accounts.

If you sign up or log in using a third-party account (such as Apple or Google), we receive information such as your name, email address, and profile details, consistent with the third party’s privacy settings.

Service Providers.

We may collect information through service providers acting on our behalf.

Other Users.

We may receive information about you from other users, such as comments, match invitations, or rating inputs.

Corporate Transactions.

If we undergo a merger, acquisition, financing, or similar transaction, information may be transferred as part of that transaction.

HOW WE USE YOUR INFORMATION

To Provide the Services

We use personal information to create and manage accounts, operate tournaments, generate rankings and ratings, display standings, facilitate communication between users, and otherwise provide core platform functionality.

To Process Subscriptions

We process subscription and payment information to manage billing and provide paid features.

To Enable Competitive and Performance Features

We process participation data, match outcomes, rankings, ratings, and related information to generate leaderboards,
matchups, tournament brackets, and performance analytics.

To Personalize the Experience

We use information to personalize your experience, including suggesting tournaments, teams, opponents, events, and content.

To Provide AI and Algorithmic Features

We may use machine learning and artificial intelligence technologies to enhance ranking systems, match suggestions, anomaly detection, competitive integrity monitoring, and other features. AI-generated outputs are probabilistic and may contain inaccuracies.

To Communicate With You

We use contact information to send service updates, support responses, security alerts, transactional messages, and promotional communications where permitted by law.

To Improve and Analyze the Services

We use analytics to understand usage patterns, improve functionality, troubleshoot issues, and enhance user experience.

To Provide Marketing and Sponsored Content

We may use information to display sponsored tournaments, branded challenges, advertisements, and promotional
content. Where required by law, we obtain consent for targeted advertising.

To Protect Users and the Platform

We process information to enforce our Terms of Service, detect fraud, prevent manipulation of rankings or match outcomes, investigate abuse, ensure safety, and comply with legal obligations.

For Legal and Regulatory Compliance

We process information as required to comply with legal obligations, respond to lawful requests, and protect our legal
rights.

HOW WE SHARE YOUR INFORMATION

Information Visible to Others

Depending on your privacy settings, certain profile and participation information may be visible to other users or the public, including rankings, ratings, standings, and match results.

Service Providers

We share information with service providers who support hosting, analytics, payment processing, communications, customer support, and security.

Third-Party Integrations

If you connect third-party services or share content externally, information will be governed by those third parties’ policies.

Partners and Sponsors

We may share information with event organizers or sponsors where you direct us to do so or where necessary to operate a sponsored event.

We may share information within our corporate family and in connection with mergers, acquisitions, financing, or similar
transactions.

Legal Requirements and Harm Prevention

We do not sell personal information for monetary consideration.

CHILDREN’S PRIVACY

The Services are not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13.

We implement additional privacy protections for users under 18, including age-based default privacy settings.

DATA SECURITY

We implement administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. However, no system is completely secure.

DATA RETENTION

We retain personal information for as long as necessary to provide the Services, fulfill legal obligations, resolve disputes, enforce agreements, and maintain competitive records.

INTERNATIONAL DATA TRANSFERS

If you access the Services from outside the United States, your information may be transferred to and processed in the
United States. Where required, we implement appropriate safeguards for international transfers, such as Standard Contractual Clauses.

We do not discriminate against users for exercising privacy rights.
